Welcome to TruckTidy. The trucktidy.ca website and online store are owned and operated by Active Corporation Inc., Ontario, Canada ("TruckTidy", "we", "us" or "our"). By using our website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site.

1. Other Policies

These Terms include our Refund Policy, Shipping Policy and Privacy Policy, which also apply to your use of the site and your purchases. If these Terms conflict with one of those policies on a topic that policy covers, the policy applies.

2. Authorized Reseller

TruckTidy is an independent online retailer and an authorized reseller of the brands we carry, including Tmat and AMPLock.

  • TruckTidy is a separate business. We do not own, manufacture or control Tmat, AMPLock or any other brand sold on our site.
  • Being an authorized reseller means we are approved to sell these brands' products. It does not make TruckTidy a legal agent of any brand. We cannot make promises, warranties or commitments on a brand's behalf, and a brand is not responsible for TruckTidy's own policies or actions.
  • Brand names, logos and trademarks shown on the site belong to their respective owners and are used to identify the products we sell.
  • Manufacturer warranties, where they apply, are provided by the manufacturer under its own terms. The only warranties TruckTidy provides are those stated in our Refund Policy.

3. Use of the Site

You agree to use the site lawfully and not to engage in fraudulent, harmful or abusive activity, interfere with the site's operation, or attempt to access it without authorization. We may restrict or end access to the site for anyone who breaks these Terms.

4. Accounts

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please let us know right away if you believe your account has been used without your permission.

5. Product Information

  • We try to display products, descriptions, specifications, compatibility and images accurately. Much of this information is supplied by the manufacturer, and we do not guarantee that it is complete, current or error-free.
  • Colours and finishes may look different on your screen than in person.
  • Product descriptions, availability and prices may change without notice.

6. Fit and Compatibility

You are responsible for confirming that a product fits your vehicle, truck bed, trailer or coupler before ordering, using the vehicle selector, product details and the manufacturer's sizing information. If you are unsure, contact us before ordering. Returns for products that do not fit are handled under our Refund Policy.

7. Product Use and Safety

  • Install and use all products according to the manufacturer's instructions, warnings and safety information.
  • You are responsible for securing your cargo and for using products safely and lawfully. Some products have specific limits. For example, cargo management products may not be suitable for open-sided beds or for use with the tailgate down. Always check the manufacturer's warnings.
  • Security products, including trailer and hitch locks, are designed to deter theft but cannot guarantee it will be prevented. TruckTidy is not responsible for theft of, or damage to, any vehicle, trailer, equipment or cargo.
  • TruckTidy is not responsible for injury, loss or damage caused by improper installation, misuse, modification or failure to follow the manufacturer's instructions.

8. Orders

  • Placing an order is an offer to buy. You will receive an email confirming that we received your order. That email is not acceptance of your order.
  • Your order is accepted when it ships. Until then, we may refuse, limit or cancel any order, including for product unavailability, errors in pricing or product information, suspected fraud, or orders that appear to be for resale.
  • If we cancel an order after payment, we will refund the amount charged for the cancelled items.

9. Pricing and Payment

  • All prices are in Canadian dollars. Applicable taxes and shipping charges are calculated at checkout.
  • If a product is listed at an incorrect price, we may cancel the order and refund you, even after you receive an order confirmation.
  • Payment is processed securely through our payment provider. By submitting payment, you confirm you are authorized to use the payment method.

10. Shipping, Returns and Warranty

Shipping is covered by our Shipping Policy. Returns, refunds and warranty claims are covered by our Refund Policy.

11. Reviews and Submissions

If you submit reviews, photos, comments or other content, you confirm you have the right to share it, and you allow TruckTidy to use, display and reproduce it in connection with our business. We may remove content that is unlawful, offensive or unrelated to our products.

The site may link to third-party websites, including manufacturer websites. We do not control those sites and are not responsible for their content, products or practices.

13. Disclaimer

Except as stated in our Refund Policy, or as required by law, products and the site are provided "as is" and "as available", without other warranties of any kind, express or implied.

14. Limitation of Liability

To the fullest extent permitted by law, TruckTidy's total liability for any claim relating to a product or the site is limited to the amount you paid for that product. TruckTidy is not liable for indirect, incidental, special or consequential damages, including lost profits, lost time, or loss of or damage to vehicles, trailers, equipment or cargo.

15. Indemnity

You agree to indemnify TruckTidy and Active Corporation Inc. against claims, losses and costs arising from your misuse of products or the site, or your breach of these Terms, to the extent permitted by law.

16. Your Rights Under Consumer Law

Nothing in these Terms limits any rights you have under applicable consumer protection law, including Ontario's Consumer Protection Act, 2002, that cannot be waived or limited by agreement.

17. Intellectual Property

All content on the site, including text, graphics, logos owned by TruckTidy and site design, is protected by intellectual property rights and may not be reproduced without our permission. Third-party trademarks belong to their owners, as stated in section 2.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

19. General

  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
  • These Terms, together with the policies listed in section 1, are the entire agreement between you and TruckTidy about your use of the site and your purchases.

20. Changes to These Terms

We may update these Terms at any time by posting the new version on this page. The version in effect when you place an order applies to that order.
